Damtew was driving a semi owned by Blue Nile Enterprise when he failed to yield right of way Nov. 6, drove too fast for conditions, followed too closely, failed to maintain a safe distance, drove inattentively, failed to keep a proper lookout or use ordinary care, failed to give warning or take evasive action, and drove carelessly. Nevarrez seeks more than $75,000 for personal injuries including medical expenses, past and future economic damages, and past and future non-economic damages including pain, suffering, and mental anguish.
