Section 8: That traffic traveling east or west on Maple St., at the intersections of Maple St. and South Cedar St., shall require of the driver or operator of every motor vehicle or other vehicle shall bring the same to slow down and yield the intersection to oncoming vehicular traffic prior to entering the intersections of said streets as indicated when a yield sign is placed or located at said intersection, giving notice of such requirements.
Section 9: Any person convicted of violating any of the provisions of this section shall be punished by fine not exceeding Eighty Dollars ($80) plus court costs.
Section 10: An appropriate yield sign shall be placed at said locations designating the traffic regulations as herein set forth.
Section 11: This ordinance shall take effect and be in full force from and after its passage and publication in the official publication, Marion County Record, as required by law.

ORDINANCE NO. 1523
AN ORDINANCE OF THE CITY OF MARION, KANSAS, REGULATING AND RESTRICTING THE PLACEMENT AND MAINTENANCE OF REFUSE CONTAINERS WITHIN THE CITY LIMIITS; PROVIDING FOR PENALTIES FOR VIOLATIONS HEREOF; AND REPEALING ANY OTHER ORDINANCES, OR PORTIONS THEREOF, IN CONFLICT HEREWITH.
WHEREAS, the Governing Body of the City of Marion wishes to establish an ordinance regarding the location and maintenance of refuse containers within the city limits;
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MARION, KANSAS:
SECTION 1. Residential refuse container location and maintenance shall occur as follows:
SECTION l(A) COLLECTION FROM THE ALLEY If the sanitation truck makes the collection of refuse from the alley, permanent or disposable refuse containers shall be placed on private property near the alley line in racks or in designated spaces with rails or guards to prevent them from being overturned.
SECTION l(B) COLLECTION FROM THE STREET If the refuse collection vehicle makes the collection of refuse from the street (with no alley access only), disposable containers or permanent solid waste containers, not provided by the city, shall be placed by the resident near the back of the curb or edge of the roadway but not in the street. Such containers shall not be placed out for collection earlier than 5:00 p.m. on the day prior to scheduled collection, nor later than 8:00 a.m. on the day of scheduled collection. All collection containers shall be moved to their normal storage location at a point behind the front building line within twenty-four (24) hours after collection. Exemptions to the curb line placement of such containers may be made by the director of public works for valid physical reasons.
SECTION l(C) MAINTENANCE OF REFUSE CONTAINERS Person or persons in charge thereof shall maintain containers in a clean manner. Garbage shall be drained and wrapped before depositing in said container. Both garbage and rubbish may be placed in the same container. The owner or occupant shall use such·disposal bags provided for garbage and rubbish by the City of Marion, Kansas or of similar type and size commercially available. Such bags when full shall be closed for convenient handling.
SECTION l(D). PENALTY. Every person convicted of a violation of any of the provisions of this article for which no penalty has been provided shall for the second conviction thereof be punished by a fine of not more than $25.00. Upon a third or subsequent conviction within one year after the first conviction, such person shall be punished by a fine of not more than $50.00.

AN ORDINANCE OF THE CITY OF MARION, KANSAS PERTAINING TO THE SOLID WASTE RATES; AMENDING SECTION 15-410 SCHEDULE OF CHARGES; AND REPEALING SAID SECTION AS IT PREVIOUSLY EXISTED.
BE IT ORDAINED by the Governing Body of the City of Marion, Kansas;
Section 1. Section 15-410 of the Code of the City of Marion, Kansas is hereby amended as follows:
The City of Marion in providing these services of garbage and rubbish control and collection, in order to prevent unsanitary, unsightly and dangerous conditions caused by the accumulation of garbage and rubbish shall collect a service charge to defray the costs and maintenance of services which shall be computed on the following basis.

Section 2. All ordinance or parts of ordinances conflicting with any of the provision of this ordinance are herby repealed and replaced included in Ordinance 1447.
Section 3. This ordinance shall be in full force and effect with the June 2026 utility billing cycle, and January 2027, January 2028, January 2029, January 2030, and January 2031 utility bilJing cycles, after its passage and publication for two (2) consecutive weeks in the Marion County Record, the official city newspaper.
