Does a dog bite
merit a $75,000 suit?

A Peabody man is suing the owner of three dogs that allegedly attacked him last July on his way home from work.

Robert Berg seeks more than $75,000 from Dinah Richmond for pain and suffering, mental anguish, loss of time, loss of enjoyment of life, medical expenses, economic loss, permanent disfigurement, and physical disability.

Wichita lawyer Drew Steadman, who represents Berg, said Berg had been walking home near the intersection of Sycamore and Division when the dogs suddenly charged him from across the way July 7.

“They were not paying attention to him, and all of a sudden they were paying attention to him,” Steadman said. “The dogs ran into the street and got him there.”

Steadman said the dogs bit and scratched Berg’s right leg multiple times, leaving puncture wounds in the back of his calf.

Richmond called the dogs in, Steadman said.

A Peabody police department incident report written by Kaitlin Brunner said Berg required emergency medical services after being bitten by all three dogs.

According to the petition, Richmond was negligent by not securing the dogs, keeping a known aggressive dog, allowing a hazardous condition to exist, failing to eliminate a dangerous condition, failing to use reasonable care, and violating city, county, state and federal laws.
