A judge granted a motion in favor of USD 410 regarding a joint project between the school district and Tabor College.
Raymond Brandt filed a lawsuit last year, the day before school district constituents approved a bond issue to remodel and construct a new athletic facility on the college campus.
On Aug. 19, Eighth Judicial District Judge Hornbaker filed the ruling. That evening, USD 410 board of education held a special board meeting that was planned before the ruling was known, and superintendent Doug Huxman issued this statement.
“We always felt that we acted in the best interest of the school district in saving money in a jointly-owned athletic facility with Tabor College. We were confident that the court would agree with us and we’re pleased with the ruling.”
When asked if the school district was moving forward with the improvement project which was at the heart of the lawsuit, Huxman had no comment.
Brandt said he was disappointed but would not elaborate regarding his plans.
Brandt and his attorney, Susan Schrag of Morris Laing Evans Brock & Kennedy, have 30 days to file an appeal.
