Criminal division

The following information has been filed in the criminal division of Marion County District Court:

Anthony Alexander Ebaben, indecent liberties with a child older than 14 and younger than 16, sexual battery, furnishing alcohol to a minor, driving while license suspended; preliminary hearing at 9:30 a.m. Nov. 7.

Allison Shults, three counts of making a false writing, theft of at least $1,000 but less than $25,000 (violation date of Jan. 11); arraignment at 9:45 a.m. Nov. 5.

Roscoe J. Czarnowsky, preliminary hearing continued to 9:30 a.m. Oct. 17.

Cory Helmstead, preliminary hearing continued to 9:30 a.m. Nov. 7.

Allison Shults, four counts of giving a worthless check for less than $500 (violation dates of May 16, May 17, May 18, June 1); arraignment at 9:45 a.m. Nov. 5.

Marc A. Thomas, probation revoked, defendant ordered to serve modified sentence of 19 months with 12 months post-release supervision, serve three weekends in Marion County Jail beginning Sept. 28 through Oct. 12, 54 days of house arrest.

Calvin Dirksen, permitting a dangerous animal to be at-large; upon motion of county attorney case dismissed without prejudice and costs assessed to the state.

Michael T. Loomis, domestic battery (violation date of April 23); upon motion of county attorney case dismissed without prejudice and costs assessed to the state.

Mark Edward Sattler, battery; case dismissed without prejudice based on victim's failure to appear, costs assessed to the state.

Michael Wheeler, pleaded guilty to attempted possession of methamphetamine, controlling sentence for 17 months, supervised probation with community corrections for 18 months with mandatory drug treatment.

Michael T. Loomis, upon motion of county attorney, motion to terminate diversion is withdrawn.

Randy Herbel, rape of a child under the age of 14, aggravated indecent liberties with a child under the age of 14 (violation dates of Aug. 1 and 2, 2006); attorney Douglas P. Jones files motion to withdraw as defendant's attorney; status hearing at 11 a.m. Oct. 10.
