Marion council accused of open meetings violation

Found not to be in violation

A complaint was filed with Marion County Attorney Susan Robson regarding a possible open meetings violation by the City of Marion.

At a Feb. 26 city council meeting, a third party was invited by the city council to participate in an executive session.

The city invited Marion Planning Commission and USD 408 representatives to discuss attorney-client privilege in the executive session.

Robson said a letter was sent to Marion City Attorney Dan Baldwin with a copy of the letter sent to the individual who filed the complaint.

Robson stated in the letter that she had reviewed minutes from the meeting, state statute, and consulted with the League of Kansas Municipalities regarding the matter. It was in Robson's opinion that the reason for entering the executive session was a judgment call for the city attorney and she believed the city council substantially complied with the state statute.

The county attorney also advised the city council to review state statute prior to entering executive sessions to assure compliance.
