Owner ordered to halt cage construction
Owner did not apply for required building permit
It came to the attention of David Brazil, Marion County zoning administrator, that an exterior cage for exotic animals was being constructed at 2140 40th.
This location is under investigation by the Marion County Sheriff's Department and United States Department of Agriculture for the possible mistreatment of animals, storage of anhydrous ammonia in an unapproved container, improper disposal of animal carcasses, and improper disposal of hazardous and household waste.
Following an on-site inspection Jan. 2, Brazil informed Christopher McDonald, owner of the animals and resident on the property, that a building permit was necessary for the construction. The exterior cage was to surround the existing cage that houses the animals.
Brazil returned Monday to post a 48-hour notice to cease construction and reported that no construction had taken place.
According to the Marion County zoning regulations, a proper application must be made in order to construct a structure, such as a fence. The county has up to 20 days to issue a permit, once proper application has been made.
"Mr. McDonald is familiar with the process," said Brazil. "He previously applied for and received a construction permit on the property."
Brazil said he was concerned about the current operations on the property.
"The property and operations are both a safety and health issue," said Brazil.
